ACCEPTABLE USE POLICY

This Acceptable Use Policy governs the proper use of the services and website operated by Up Network Maroc.


🛡  Purpose and Legal Status of This Policy

This Acceptable Use Policy (“AUP”) defines the standards of conduct required of all users of the Up Network Maroc website and services. It forms part of the binding contractual agreement between Up Network Maroc and each user, supplementing our Terms and Conditions.

Violations of this AUP may result in suspension or termination of access, civil liability, and referral to law enforcement authorities, in accordance with applicable Moroccan law and international regulations.

This policy applies to all users including visitors, registered users, clients, and third parties accessing the website or services in any capacity.

 

1. Introduction and Scope

This Acceptable Use Policy (“AUP” or “Policy”) governs the proper and lawful use of the website located at www.upnetworkmaroc.com and all associated services, platforms, and digital tools operated by Up Network Maroc (“we”, “our”, or “us”).

This AUP applies to:

  • Clients who have entered into service agreements with Up Network Maroc

  • Engaging in any activity that constitutes a criminal offence or gives rise to civil liability under Moroccan law or applicable international law

3.2 Security and Infrastructure Violations

  • Attempting to gain unauthorised access to any part of the Website, its servers, databases, backend systems, or associated networks
  • Probing, scanning, or testing the vulnerability of the Website’s infrastructure without prior written authorisation from Up Network Maroc
  • Circumventing, disabling, or tampering with any security measure, authentication system, digital rights management tool, or access control mechanism
  • Conducting or facilitating denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against the Website or any third-party infrastructure
  • Introducing, uploading, or transmitting malicious code, viruses, worms, ransomware, spyware, trojan horses, or any other harmful or disruptive software
  • Intercepting, monitoring, or capturing data transmitted through the Website without authorisation
  • Using the Website to launch attacks or exploit vulnerabilities in third-party systems or networks

3.3 Intellectual Property Violations

  • Reproducing, copying, distributing, or creating derivative works from any content on the Website without prior written authorisation from Up Network Maroc
  • Uploading, transmitting, or sharing content that infringes the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party

3.4 Data and Privacy Violations

  • Collecting, harvesting, scraping, or extracting personal data of other users or third parties without their explicit consent and in violation of applicable data protection law
  • Using the Website to send unsolicited commercial communications (spam), phishing messages, or any other form of electronic harassment
  • Impersonating any person or entity, including Up Network Maroc employees, representatives, or other users
  • Processing or transmitting personal data through the Website in violation of GDPR, Loi n° 09-08, or any other applicable data protection regulation
  • Using personal data obtained through the Website for any purpose other than that for which it was provided

3.5 Service Abuse and Platform Integrity

  • Using automated bots, scrapers, crawlers, or scripts to access, extract, or interact with the Website without prior written authorisation from Up Network Maroc
  • Overloading, flooding, or otherwise placing an unreasonable or disproportionate technical burden on the Website’s infrastructure
  • Creating multiple accounts to circumvent access restrictions, suspensions, or other enforcement measures
  • Interfering with the proper functioning of the Website or degrading the experience of other users
  • Posting, uploading, or transmitting content that contains unsolicited advertising, promotional material, or commercial solicitations not authorised by Up Network Maroc
  • Using the Website or services to facilitate, promote, or enable any of the activities prohibited under this AUP

3.6 Content Standards

  • Promote or glorify violence, self-harm, or any illegal activity

4. Client-Specific Obligations

In addition to the general obligations set out in Section 2 and the prohibitions in Section 3, clients who use Up Network Maroc’s professional services (including digital marketing, web development, or consulting services) agree to:

  • Ensure that all materials, content, and data provided to Up Network Maroc for use in service delivery comply with applicable law and the policies of any relevant third-party platforms (including Meta, Google, and similar advertising networks)
  • Obtain all necessary licences, consents, and authorisations before providing third-party content or personal data to Up Network Maroc for processing
  • Not instruct Up Network Maroc to carry out any activity that would constitute a violation of this AUP, the Terms and Conditions, or applicable law
  • Promptly notify Up Network Maroc if you become aware of any misuse of your account or services, or any suspected breach of this AUP
  • Accept full responsibility for the lawfulness of any content you supply, and indemnify Up Network Maroc against any claims arising from such content in accordance with the indemnification provisions of the Terms and Conditions

 

5. Security Incidents and Vulnerability Disclosure

5.1 Reporting Security Vulnerabilities

If you discover a potential security vulnerability or technical flaw in the Website or its infrastructure, we encourage responsible disclosure. Please report it to us promptly at:

We ask that you:

  • Provide sufficient detail to allow us to reproduce and assess the issue
  • Not exploit the vulnerability or use it to access, modify, or delete data

5.2 Unauthorised Security Testing

Any security testing, penetration testing, or vulnerability scanning of the Website’s infrastructure without prior written authorisation from Up Network Maroc is strictly prohibited and may constitute a criminal offence under Moroccan law. Authorised security assessments must be conducted under a separate written agreement.

 

6. Enforcement and Consequences of Violation

Up Network Maroc takes violations of this AUP seriously and reserves the right to take any action it deems appropriate in response to a suspected or confirmed violation, including:

Civil legal action Violations causing financial loss, reputational damage, or harm to third parties
Referral to law enforcement Criminal conduct including hacking, fraud, distribution of illegal content, or data theft
Notification to relevant authorities Violations involving personal data breaches, CNDP reportable incidents, or regulatory contraventions

Our enforcement decisions are made at our sole reasonable discretion and do not require prior notice except where expressly required by applicable law or contract.

 

7. Reporting Abuse and Violations

Up Network Maroc encourages users to report any conduct they believe violates this AUP or applicable law. Reports help us maintain a safe, lawful, and trustworthy environment for all users.

8. Third-Party Platform Compliance

Where Up Network Maroc’s services involve the use of third-party platforms (including Meta, Google, LinkedIn, or other digital advertising and technology platforms), users and clients must comply not only with this AUP but also with the applicable terms of service and community standards of those platforms.

Up Network Maroc will not execute instructions that would constitute a violation of a third-party platform’s policies, regardless of client instruction. We reserve the right to decline, modify, or suspend any campaign or service where we reasonably believe compliance with platform policies or applicable law cannot be maintained.

 

9. Relationship to Other Legal Documents

This AUP forms part of the broader legal framework governing your use of the Up Network Maroc website and services. In the event of any inconsistency between this AUP and another document in the framework, the following order of precedence shall apply:

10. Governing Law and Jurisdiction

This Acceptable Use Policy is governed by and construed in accordance with the laws of the Kingdom of Morocco. Any dispute arising from or in connection with this AUP shall be subject to the exclusive jurisdiction of the Tribunal de Première Instance de Tétouan, Morocco.

Where services are provided to users or clients based in the European Union, applicable EU consumer and data protection regulations may additionally apply to the extent required by mandatory law.

 

11. Updates to This Policy

Up Network Maroc reserves the right to update this AUP at any time to reflect changes in law, technology, or our services. When material changes are made, we will update the “Last Updated” date and, where appropriate, display a notice on the Website. Continued use of the Website or services following any update constitutes acceptance of the revised AUP.

We recommend reviewing this page periodically. All previous versions of this AUP are superseded by the current published version.
